I welcome you and invite you to read the present Conditions of Purchase of my products (hereinafter, the "Conditions"), which are complemented by the Legal Notice and the Privacy Policy so that you have all the necessary information regarding the electronic transactions you carry out on this website.

Cervezas Althaia is committed to transparency and clarity in commercial transactions carried out on this website, guaranteeing a space committed to the rights of users and customers. Therefore, I recommend that before purchasing the products I make available to you on this website, you read these Conditions that apply to said purchase.

These Conditions regulate the contractual relationship between Cervezas Althaia, represented by ALTHAIA ARTESANA S.L., with registered office at Avd. Jaume I nº 34 4º C . 03590 Altea (Alicante, SPAIN), NIF/CIF number B54958087, whose main activity is Craft Beers, and the buyer who acquires the products offered by Cervezas Althaia (hereinafter, the “Buyer”).

These Conditions apply strictly to all product sales made in Spain, including the Balearic Islands, by Cervezas Althaia.

These Conditions are available to the Buyer in Spanish and can be accessed and downloaded at any time.

The Conditions may be modified at any time, which will be communicated to the Buyer via email or a notice on Cervezas Althaia's website.

Buyer's Age

Only persons over 18 years of age may purchase, in their own name and right. Otherwise, the responsibility for placing orders by minors will fall to the parents or legal guardians of the minor.

Purchase Process

1. The Buyer must select the product(s) and add them to the Cart.
2. The Buyer must confirm the products they have added to the Cart.
3. The Buyer must complete the registration form requesting the necessary data to manage the order and make the shipment.
4. The Buyer must choose the shipping method.
5. The Buyer must accept the General Purchase Conditions.
6. The Buyer will choose the payment method and proceed to make the payment.
7. The Buyer will receive an email confirming their order.

Products and offers

The offers presented by Cervezas Althaia are valid within the limits of available stock. Cervezas Althaia reserves the right to modify the product assortment based on difficulties imposed by its suppliers.

The photographs, graphics, and descriptions of the products offered for sale are merely illustrative and do not commit Cervezas Althaia in any way.

Prices and payment method. Invoicing

All prices include the applicable VAT on the day of the order; any change in the VAT rate will be automatically applied to the prices of the products for sale at Cervezas Althaia.

Offers on products for sale at Cervezas Althaia will be displayed in the "Offers" section or indicated on the product sheet and, unless otherwise stated, will be valid as long as they are displayed on screen.

The accepted payment methods are as follows:

• Bank Card: Cervezas Althaia uses the following payment gateways:
  • Gateway: Paycomet. The bank cards accepted by this gateway are: Visa, MasterCard, Maestro
  
  Any other type of card different from those listed above will not be accepted for payment. Through this payment method, Cervezas Althaia does not collect or handle any customer data related to their card number. All data is processed directly by the corresponding financial institution, thus offering you the highest security and confidentiality in the transaction.

The purchase invoice is sent to the email address indicated by the Buyer during the registration process at Cervezas Althaia.

Shipping and delivery times

  1. The purchased products will be delivered to the person and address indicated in the order.

  2. There will be no dispatch or delivery of orders on Saturdays, Sundays, and holidays.

  3. However, any delay will not imply cancellation of the order or any compensation.

  4. An order is considered delivered when the carrier delivers the package(s) to the customer and the customer signs the delivery receipt document.

  5. It is the customer's responsibility to verify the condition of the goods upon receipt and to report any anomalies on the delivery receipt.

Returns and right of withdrawal

Returns

• The product is defective or has been damaged during transport:
  If the product is defective, the Buyer can return it with all its accessories, with Cervezas Althaia covering the shipping costs generated by the delivery of the product and its return. Cervezas Althaia will proceed to resend the repaired or replaced product, completely free of charge. If the product has been damaged during transport, the Buyer must notify me within a maximum period of 24 hours from receiving the product and note the incident on the carrier's delivery note. When receiving the order, before opening the package, the Buyer must verify that the packaging is in good condition. If the Buyer observes any anomaly before opening the product, I ask that they do not open the seal or packaging of the product. Cervezas Althaia provides the Buyer with my transport company for the collection of the goods, free of charge. If the Buyer wishes to return the goods with a transport company other than that proposed by Cervezas Althaia, and the transport company selected by the buyer offers higher rates, the buyer will assume the difference in transport cost.
• The product does not reach its destination or does not match the description I publish:
  If the purchased product does not reach its destination, Cervezas Althaia will fully refund the money to the Buyer. If upon receiving the product the Buyer observes that it does not match the description I publish in my online store, Cervezas Althaia will proceed with a full or partial refund. To do this, the Buyer must contact Cervezas Althaia by phone at 605591288 or by email at info@althaiaartesana.com to process the return of the order.

If the customer has returned a product based on an alleged defect or error in the merchandise, and it is finally determined that no such defect or error exists, the return costs will be borne by the customer.

Withdrawal

The Buyer may also exercise their right of withdrawal within a maximum period of fourteen (14) calendar days from receipt. The refund of the purchase amount will be made once the condition of the merchandise has been verified and will be processed through the same payment method used for the order and, in any case, within a maximum of 14 calendar days from the reliable receipt of the request for withdrawal, provided that Cervezas Althaia manages the collection of the item. If the buyer returns the item through a transport company of their choice, the 14-day period will begin to run from the moment Cervezas Althaia has effective knowledge of the shipment of the merchandise or, failing that, from the receipt of the item.

The Buyer will assume the decrease in value of the goods resulting from handling them in a manner different from that necessary to establish their nature, characteristics or functioning. In this regard, Cervezas Althaia will analyze the condition of the product for which the right of withdrawal has been exercised, and in the appropriate cases, will reliably communicate to the Buyer the existence and amount of this depreciation in the price of the product, justifying it in all cases on objective and verifiable criteria.

As indicated in article 103, paragraphs d) and g) of Royal Legislative Decree 1/2007 of November 16, the right of withdrawal may not be exercised with respect to goods that may deteriorate or expire rapidly, nor with respect to the supply of alcoholic beverages whose price has been agreed at the time of entering into the sales contract and which cannot be delivered within 30 days, and whose real value depends on market fluctuations that the entrepreneur cannot control. In addition, in the case of Cervezas Althaia, the following cases are taken into account for which withdrawal is not viable:

The return costs derived from exercising the right of withdrawal will be borne by the buyer. The Buyer may exercise their right of withdrawal by sending the following form by email to info@althaiaartesana.com:

Promotional Codes

At Cervezas Althaia, we strive to ensure the best possible experience for our customers. However, we want to clarify that cancellations or returns are not accepted in situations where a promotional discount has not been applied correctly or by mistake at the time of purchase.

It is the customer's responsibility to ensure that any promotional code is entered and applied correctly before finalizing the transaction. Once the purchase is confirmed, it will not be possible to apply discounts retroactively or make price adjustments.

To ensure that discounts are applied correctly, we suggest reviewing all details before proceeding with payment. If you have any questions or need assistance, our customer service team is available through our usual channels.

Customer service

You can contact Cervezas Althaia by sending an email to info@althaiaartesana.com. I also inform you that if you submit a complaint or claim through this channel and are not satisfied with the solution I provide, if you wish, you can go to the Altea Consumer Portal.

Warranty

The products I offer at Cervezas Althaia are guaranteed nationwide against manufacturing defects for two years from the date of delivery. The warranty does not include damage caused by misuse or normal wear and tear.

Repair and replacement will be free of charge for the consumer and user. This gratuity will include the necessary expenses incurred to remedy the lack of conformity of the products with the contract, especially shipping costs, as well as costs related to labor and materials.

Unless proven otherwise, products will be considered to conform to the purchase if they meet all the following requirements:

  a) They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.

  b) They are fit for the uses to which products of the same type are ordinarily intended.

  c) They display the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product.

Data protection

The privacy policy published on the website will apply, to which I refer to avoid unnecessary repetition regarding the Buyer's personal data, provided by them, for the purchase of my products.

However, I provide you with the following information in accordance with the General Data Protection Regulation and the Organic Law on Data Protection and Guarantee of Digital Rights.

The personal data you provide me for the purchase of my products will be used to manage said purchase. The legal basis for data processing for this purpose is the execution of these contractual conditions.

Likewise, your data may be used to send you information about my products and services by electronic means. The legal basis for processing your data for this purpose is Cervezas Althaia's legitimate interest in retaining its customers and keeping them informed about my services and products that may be of interest to them. You may object to receiving such information through the simple and free procedure I provide in each commercial communication.

Interested parties have the right to:

  – Request access to personal data concerning the interested party.

  – Request its rectification or deletion.

  – Request the limitation of its processing

  – Object to processing

  – Request data portability

Interested parties also have the right to file a complaint with the supervisory authority, in this case, the Spanish Data Protection Agency, if they consider that the processing of personal data concerning them infringes data protection regulations.

Applicable legislation and jurisdiction

The parties submit to Spanish law for the resolution of any disputes that may arise and to the courts and tribunals of the Buyer's domicile as a user or consumer.
